Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Absolute Ear ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and the developer of Absolute Ear ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of the App

Absolute Ear is an ear training application for iOS that teaches musical note recognition, melodic dictation, and interval recognition through structured, progressive practice sessions.

Free Tier

The first five (5) course modules are available at no charge and do not require account creation. You may use guest mode to access these modules without signing in.

Premium Access

Modules beyond the first five require an active subscription, a one-time lifetime access purchase, or, for individual instrument packs, a one-time in-app purchase. See Section 5 for full details.

3. Accounts

Creating an Account

You may create an account using Sign in with Apple. By doing so, you authorize us to receive your Apple-provided name and email address (or Apple's relay email address if you choose to hide your email).

Guest Mode

You may use the free tier without creating an account. Progress made in guest mode is stored locally on your device and is not backed up to our servers. If you uninstall the App or clear your device data, guest mode progress cannot be recovered.

Account Responsibility

You are responsible for maintaining the security of your Apple ID. You are responsible for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

4. Age Requirements

The App is not directed to children under the age of 13. By using the App, you represent that you are at least 13 years old. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

5. Subscriptions and In-App Purchases

Subscriptions

Premium access to the full course is available via auto-renewing subscriptions:

• Monthly subscription — billed monthly
• Annual subscription — billed once per year

Subscriptions are managed and billed through Apple's App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the renewal date.

You may manage or cancel your subscription at any time in your iPhone Settings → Apple ID → Subscriptions. Canceling a subscription stops future renewals but does not entitle you to a refund for any current billing period.

Lifetime Access

Lifetime access to the full course is available as a one-time in-app purchase. This is a non-consumable purchase that permanently unlocks all current and future course modules for the purchasing Apple ID, with no recurring charges. If you reinstall the App, you can restore this purchase at no charge using the in-app restore function.

Instrument Pack Purchases

Additional instrument sample packs are available as one-time in-app purchases. These are non-consumable purchases and are permanently available to the purchasing Apple ID. If you reinstall the App, you can restore these purchases at no charge using the in-app restore function.

Pricing

Current pricing is displayed in the App at the time of purchase. We reserve the right to change subscription and purchase pricing at any time, with reasonable notice.

Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly at reportaproblem.apple.com. We have no ability to issue refunds on Apple's behalf.

Free Trial

If a free trial is offered, unused portions of a free trial are forfeited when a subscription is purchased. Trial availability and duration are displayed in the App at the time of offer.

6. Data Collection and Privacy

What We Collect

When you create an account via Sign in with Apple, we receive:

• Your name (or the name you provide)
• Your email address or Apple's private relay email address

We also store your practice data in the cloud, including:

• Session history and accuracy statistics
• Per-note and per-unit performance data
• Streak and progress information

This data is stored on servers provided by Convex (our cloud backend provider) and is associated with your account.

Local Storage

Whether or not you have an account, the App stores practice data locally on your device. This data remains on your device and is also synced to our servers if you are signed in.

Third-Party Services

The App uses the following third-party services which may collect data in accordance with their own privacy policies:

• RevenueCat — manages subscriptions and in-app purchases. RevenueCat may collect device identifiers and purchase history to manage entitlements and prevent fraud.
• Convex — our cloud database and authentication provider.
• Apple — Sign in with Apple authentication and App Store payment processing.

Analytics and Crash Reporting

The App may collect anonymized usage data and crash reports to help us improve the product. This data does not identify you personally.

Your Rights

You may request deletion of your account and associated data by contacting us at the address in Section 14. Upon deletion, your cloud-stored practice data will be removed from our servers within 30 days.

7. Intellectual Property

All content in the App — including but not limited to audio samples, course content, graphics, the app interface, and underlying software — is owned by us or licensed to us and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute any portion of the App
• Reverse engineer or attempt to extract the source code
• Use the App's audio samples outside of the App
• Resell or sublicense access to the App or its content

8. Acceptable Use

You agree to use the App only for its intended purpose of personal ear training and music education. You agree not to:

• Attempt to gain unauthorized access to our servers or another user's account
• Use the App in any way that violates applicable law
• Interfere with or disrupt the App or servers connected to the App
• Use automated tools to scrape, crawl, or interact with the App

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Any defects will be corrected
• The App or its servers are free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, the above limitations apply to the extent permitted by law.

11. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in accordance with applicable United States law.

You agree to resolve any dispute with us informally first by contacting us at the address below. If a dispute cannot be resolved informally, both parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If changes are material, we will provide notice within the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your account and access to the App at our discretion, including for violation of these Terms. Upon termination, your right to use the App ceases immediately. Sections 7, 9, 10, and 11 survive termination.
